Term and Conditions

Please read the Terms and Conditions of VolunQuest carefully before submitting your online application form. By clicking on the box besides the words ‘I have read and agree to the VolunQuest legal terms and conditions’ and agreeing to them in the online booking application form, you agree to the following terms and conditions.

Travel

The program participant is solely responsible for arranging and paying for their own travel, specifically including all airfares or other transport costs to and from the host country. It is the responsibility of the program participant to carry all necessary documents when travelling abroad. While VolunQuest may advise the program participant on required travel documentation, VolunQuest are not responsible for any supporting documents necessary for the program participant’s travel needs or other purposes.

Insurance

VolunQuest does not provide the program participant with insurance of any kind. Travel insurance is mandatory for each program participant, and the program participant will purchase this prior to departing on the trip. The program participant is solely responsible for evaluating and determining the type, extent and levels of any insurance coverage they need or desire for their planned program participant travel period. However, it must cover their entire travel period.  Proof of this insurance must be provided before the start date of the program.  If proof of insurance is not provided, VolunQuest will consider this as a late cancellation and will apply all late cancellation conditions to the program participant.

Application and Registration Process

Once the program participant has submitted their online application form, a program participant coordinator will contact them via e-mail with a letter of acceptance or rejection to the program.  If the program participant is accepted for the program, a start date and program placement will be included in their acceptance letter.  To hold the program participant’s placement a 50% deposit must be paid in full.  The program participant has one month (thirty days) from the date of the acceptance letter to pay their deposit in full.  If the registration deposit is not paid in full by the end of the thirtieth day, VolunQuest does not guarantee that the program participant’s placement will still be available.

Payment

Payment in US$ can be made with total security online, by bank transfer or by PayPal.

Cancellations

Where a cancellation is received 30 days or more before the program is due to start, a student’s unused fees can be held on account for up to 12 months. In other words, the unused fees (not including a $120 USD cancellation fee) can be applied to any of the programs offered at VolunQuest for up to a maximum of 12 months after the cancellation date.

For cancellations received with less than 30 days notice, the deposit is non-refundable. Once the program has started, the cost of the entire program is non refundable.

Please note: We recommend all students take out a program cancellation insurance policy to protect them against such an incident.  VolunQuest reserves the right to revise the cancellation policy at any time. All cancellation policy revisions will be made via the VolunQuest website with seven days advanced notice given before they take affect. Cancellation policy revisions are not applicable to program participants who have already submitted their online booking before the revisions are due to take affect.  A program participant’s placement on a program cannot be confirmed until the deposit has been paid in full. All deposits attract a 5% transaction fee charge to cover PayPal fees (where applicable).

Program Fees

Details of the program fees are set out on our website.  Program fees are due 30 days prior to the beginning of the program participant’s program placement. Failure to make this payment can result in a loss of program participant placement with no refund of the deposit.  Program fees are not subject to the 5% transaction fee.  If program fees are paid in full at the time of registration, the deposit will not be charged separately and therefor will not be subject to the 5% transaction fee.

Deposits and program fees are not transferrable to other persons.

Change of Dates and Duration

Once registered and before they begin their trip with VolunQuest, the program participant is entitled to change their start date and duration once, at no additional cost. If they need to change their start date or duration a second time they will be required to pay an administration fee of US$50 for each change they make.  This can only be done after the deposit is paid and 30 days before the original start date.

Personal Risks

The program participant acknowledges and accepts the responsibilities and risks associated with their agreement to travel to, temporarily live in and provide volunteer services in a developing country. Such travel and volunteer work can be often hazardous and involves a certain degree of risk, inherently dangerous activities and personal perils to the program participant, both foreseen and unforeseen, all of which are fully accepted by and solely assumed by the program participant. Therefore, VolunQuest including any and all of its employees, managers, directors, shareholders, host families and host country partner organizations are not liable, to the maximum extent of the law, for any loss or harm the program participant or associates may suffer, including but not limited to loss caused directly or indirectly by:

  • Personal injury;
  • Emotional injury;
  • Death;
  • Illness or disease;
  • Damage to or loss of property;
  • Hostage situations; or
  • War or terrorism.

Indemnity

The program participant agrees to indemnify VolunQuest against any and all liability which VolunQuest incurs arising directly or indirectly out of, or in connection (in any way) with, the program participant’s travel to, living in and providing services in the program participant’s nominated country.

Drug and Alcohol Use

The program participant must abide by the rules put in place by VolunQuest and its partner organizations, program participant placement institution and host family in regards to alcohol consumption. Drug use (unless prescribed by a doctor) and underage drinking (18 years old) are both strictly prohibited and will result in instant dismissal from the program with no refund.

Miscellaneous

The program participant agrees to comply with all partner organizations’ codes of conduct.

VolunQuest reserves the right to use feedback and images provided by program participants for website materials such as testimonials.

VolunQuest provides a service connecting program participants to partner organizations.  You agree that VolunQuest is not liable for any actions or omissions of any partner organization.

To the full extent permissible at law, all representations, terms, warranties, guarantees, or conditions whether implied by statute, common law or custom of the trade or otherwise, including, but not limited to, implied warranties and guarantees, are excluded.

Notwithstanding anything else contained in any agreement, the liability of VolunQuest to the program participant shall not in aggregate exceed the amount of the registration fee paid by the program participant.

This website is presented solely for the purpose of promoting VolunQuest services and those of VolunQuest’s partner organizations. This site is controlled and operated by VolunQuest from its offices in Mexico. VolunQuest makes no representation that materials in the site are appropriate or available for use in other locations.

Those who choose to access this site from other locations do so on their own initiative and are responsible to the extent local law is applicable.

VolunQuest does not warrant or make any representations regarding the correctness, accuracy, reliability, or otherwise of the materials in this site or the result of their use.

VolunQuest and its partner organizations reserve the right to remove the program participant from the program.

Force Majeure

VolunQuest has no liability for any lack of performance, unavailability or failure of the services or its website, or for any failure of VolunQuest to comply with these terms and conditions, where the same arises from any cause reasonably beyond the control of VolunQuest.

Governing Law  

Shall be construed and enforced in accordance with the laws of Mexico.  Any legal action commenced by either party in connection with Term and Conditions and/ or services of VolunQuest shall be brought in the Court of the State of Q. Roo, and both parties consent to jurisdiction and venue of this court regardless of the residence of the parties at the time the action is commenced.

Attorneys’ Fees  

If suit, arbitration or other legal action, declaratory or otherwise, is brought by either party for the determination of any controversy arising hereunder, the recovery of any payment due hereunder or because of the breach or threatened breach of any term, covenant, or provision hereof, the party prevailing in that action shall be entitled to recover from the party not prevailing, the costs of suit and reasonable attorneys’ fees.
